Terms of Service

1. Acceptance of these terms

By accessing or using DISC Profile (the "Service") you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. These terms form a binding contract between you and WellerDeveler ("we," "us," or "our"). You must be at least 13 years old to use the Service; users under 18 must have a parent or guardian review and agree to these terms.

2. What we provide

DISC Profile offers:

• A free DISC personality screener and basic profile card.
• Paid in-depth reports including the Essentials report ($14.95) and the Full report ($29.95).
• A Pro subscription ($6.99/month) that unlocks ongoing AI coaching, advanced insights, and premium features.
• Educational content about the DISC behavioral model.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice for paid features.

3. Accounts

You can use the free assessment without an account. To purchase reports, subscribe to Pro, or save your results across devices, you need an account.

• You are responsible for providing accurate information and keeping your credentials secure.
• You are responsible for all activity on your account. Notify us immediately at support@wiredtype.com if you suspect unauthorized access.
• One account per person. Do not share accounts, sell accounts, or create accounts on behalf of others without authorization.
• We may suspend or terminate accounts that violate these terms, with or without notice depending on severity.
• You can delete your account at any time from your account settings, or by emailing privacy@wiredtype.com.

4. Payments and subscriptions

Payments are processed by Stripe. By purchasing, you authorize us (through Stripe) to charge your payment method.

One-time purchases

The Essentials report ($14.95) and Full report ($29.95) are one-time purchases. You get lifetime access to the report you purchased, subject to the Service remaining available.

Pro subscription

The Pro subscription ($6.99 per month) is billed automatically on a recurring basis until canceled. By starting a subscription you authorize recurring charges until you cancel. You can cancel at any time from your account page; cancellation takes effect at the end of the current billing period and you will retain access until then. We do not pro-rate partial months.

Pricing changes

We may change prices for new purchases or future billing periods. For active subscriptions, we will give you at least 14 days notice by email before a price change takes effect, and you can cancel before the new price applies.

Taxes

Prices are shown exclusive of taxes unless stated otherwise. You are responsible for any sales tax, VAT, or similar taxes required by your jurisdiction.

5. Refund policy

One-time report purchases. If you are not satisfied with a report, email support@wiredtype.com within 14 days of purchase and we will issue a full refund. After 14 days, report purchases are final sale.

Pro subscription. You can cancel your subscription at any time. We do not refund partial months, but you will retain access until the end of your current billing period. If you were charged for a renewal you did not intend, contact us within 7 days and we will review the charge.

Chargebacks. Please contact us first so we can resolve any issue directly. Initiating a chargeback without contacting us may result in account suspension.

6. Intellectual property

The DISC behavioral model (Dominance, Influence, Steadiness, Conscientiousness) was published by William Moulton Marston in 1928 and is in the public domain. Nobody owns "DISC" as a framework.

What is protected is everything we have built on top of that framework: our assessment questions, scoring algorithms, report content, graphics, illustrations, copy, code, interactive components, and the look and feel of the Service. All of that is owned by WellerDeveler (or our licensors) and is protected by copyright, trademark, and other laws.

We grant you a limited, personal, non-exclusive, non-transferable license to access and use the Service and your own reports for your personal, non-commercial use. You may share your personal DISC results socially. You may not copy, reproduce, distribute, resell, sublicense, or create derivative works from our content without written permission.

"DISC Profile" and the DISC Profile logo are trademarks of WellerDeveler.

7. User content

When you take an assessment, chat with our AI coach, or submit feedback, you provide "user content" to the Service. You retain ownership of your user content. By submitting it, you grant us a worldwide, royalty-free license to use, store, process, and display that content solely to operate, improve, and secure the Service, and to generate your reports. We will not sell your user content or use it to train third-party AI models.

You are responsible for the content you submit. Do not submit content that is illegal, infringes someone else's rights, contains malware, or includes personal information about others without their consent.

8. Prohibited uses

You agree not to:

• Scrape, crawl, or harvest data from the Service using automated tools.
• Reverse engineer, decompile, or attempt to extract our source code, scoring algorithms, or question bank.
• Resell, sublicense, or commercially redistribute reports, assessment questions, or any part of the Service.
• Use the Service to build a competing product.
• Submit false or misleading information, or impersonate another person.
• Attempt to bypass authentication, rate limits, paywalls, or security measures.
• Use the Service to harass, defame, or discriminate against others.
• Use the Service for employment screening, tenant screening, credit decisions, or any legally regulated decision about another person.
• Upload malware, viruses, or any code intended to disrupt the Service.
• Violate any applicable law or regulation.

We may suspend or terminate access for users who violate these rules.

9. Disclaimer

DISC Profile is a personal-insight product, not a clinical or professional assessment. The DISC model describes behavioral tendencies; it is not a medical device, a psychological diagnosis, a psychiatric evaluation, or an employment test. Our reports are for personal self-reflection and communication insight only.

Do not use DISC Profile to:

• Diagnose or treat any medical, mental-health, or psychological condition.
• Make hiring, promotion, firing, or compensation decisions.
• Make legal, financial, or medical decisions about yourself or others.

If you need professional guidance, consult a licensed clinician, HR professional, or other qualified expert.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR EXPECTATIONS OR THAT RESULTS OBTAINED WILL BE ACCURATE OR RELIABLE FOR ANY SPECIFIC PURPOSE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WELLERDEVELER AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS ($50).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In those jurisdictions, our liability is limited to the fullest extent permitted by law.

11. Indemnification

You agree to defend, indemnify, and hold harmless WellerDeveler from any claim, liability, damage, loss, or expense (including reasonable attorneys' fees) arising from (a) your use of the Service, (b) your violation of these terms, (c) your violation of any third-party right, or (d) any content you submit to the Service.

12. Governing law

These terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law principles. Any dispute not subject to arbitration (see next section) must be brought in the state or federal courts located in New Jersey, and you consent to personal jurisdiction there.

13. Dispute resolution

Informal resolution first

Before filing any formal claim, you agree to contact us at legal@wiredtype.com and try to resolve the dispute informally. We will do the same. Most issues can be worked out within 30 days.

Binding arbitration

If informal resolution does not work, any dispute arising out of or related to these terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in New Jersey (or by phone or video at your request if you are a consumer). The arbitrator's decision will be final and enforceable in any court of competent jurisdiction.

Class action waiver

You and WellerDeveler agree that any claims will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class or representative action.

Exceptions

Either party may bring claims for injunctive relief, intellectual property infringement, or small-claims-court-eligible matters in court instead of arbitration.

30-day opt-out

You may opt out of the arbitration agreement and class action waiver by emailing legal@wiredtype.com within 30 days of first accepting these terms, with the subject line "Arbitration Opt-Out" and your account email.

14. Changes to these terms

We may update these terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes we will notify account holders by email at least 14 days before the changes take effect. Continued use of the Service after the effective date means you accept the updated terms. If you do not agree, stop using the Service and close your account.
